• Under the new Section 82.1142 of the Texas Property Code, condo associations and HOAs in subdivisions that either have 60 or more units or are managed by a management company must maintain a website where all “dedicatory instruments” (declarations, bylaws, etc) are published.• Your website must be accessible to members and contain the current governing documents, management certificate identifiers, and a link/address to the website itself in certain filings.

Florida has enacted new transparency requirements for community associations. Under recent legislative updates, qualifying HOAs and condominium associations must maintain a secure website or digital portal where owners can access the association’s official records. These requirements are established through:• House Bill 1203 (2024) amending Florida Statutes §720.303(4)(b) for HOA web requirements for 100+ parcels effective January 1, 2025.• House Bill 1021 (2024) amending Florida Statutes §718.111(12)(g) for Condominium web requirements for 25+ units effective January 1, 2026.
Consequences of Failure to Meet Information Transparency Requirements
If an association does not maintain the required website or portal, owners may enforce full record-access rights under:• F.S. §720.303(5) for HOAs
• F.S. §718.111(12) for CondominiumsUnder F.S. §718.111(12)(c):
If a condominium association willfully refuses to provide access to official records within 10 working days of receiving a written request, the association is liable for $50 per calendar day, up to a statutory maximum of $500.This penalty begins on the 11th working day and continues until the records are made available or the maximum amount is reached.These laws ensure that owners have dependable access to governing documents, budgets, financial records, meeting notices, contracts, and all other required official records, even if the association has not yet met its digital posting obligations.
